1. Agreement to Terms

By accessing this website, purchasing digital products, or engaging NexCraft Studio for services, you agree to these Terms of Use. If you do not agree with these terms, please do not use our website, products, or services.

These terms apply to website visitors, users, customers, clients, and others who access our website, purchase templates, or engage our services.

2. Services and Digital Products

NexCraft Studio provides and offers:

• Business websites
• Growth websites
• Business systems and admin dashboards
• Payment gateway setup and integration
• Website maintenance and support
• Website templates, starter kits, and digital products

Specific deliverables, timelines, pricing, and support terms for custom services will be confirmed in the project proposal, quotation, invoice, or written agreement.

3. Project Terms

3.1 Project Scope

Each custom project begins with an agreed scope of work. The scope may include pages, features, integrations, design direction, content requirements, deployment support, and support period.

Any work outside the agreed scope may require additional quotation, timeline adjustment, or written approval before proceeding.

3.2 Payment Terms

Payment terms are agreed before a custom project begins. Unless otherwise stated, projects may require an initial deposit, progress payment, and final payment before launch, handover, or production deployment.

3.3 Timeline

Estimated timelines are provided in good faith based on the agreed scope. Timelines may change due to client feedback delays, late content delivery, third-party service delays, additional requests, or scope changes.

3.4 Revisions and Client Feedback

Minor refinements within the agreed scope are included. Major direction changes, additional pages, new features, new integrations, or repeated revision cycles may require additional fees and timeline adjustments.

4. Digital Products and Templates

NexCraft Studio sells website templates, starter kits, UI kits, code templates, and other digital products through this website.

Template purchases are currently priced and processed in SGD. Payments for templates are securely processed through Lemon Squeezy. NexCraft Studio does not store your payment card details.

Purchased templates are delivered digitally through your NexCraft Studio account. After successful payment, eligible templates can be accessed and downloaded from your account area.

Unless otherwise stated, digital products are licensed for personal or commercial project use by the purchaser or their organisation, subject to the applicable License Agreement.

Digital products may not be resold, redistributed, sublicensed, shared publicly, repackaged, uploaded to public repositories, or claimed as original products without written permission from NexCraft Studio.

Due to the nature of digital products, template and digital product purchases are generally non-refundable once access or download has been provided, unless required by applicable law.

5. Intellectual Property

After full payment is received, the client owns the final custom deliverables created specifically for the agreed project, unless otherwise stated in writing.

Ownership does not include third-party libraries, open-source frameworks, licensed assets, fonts, stock images, platform services, reusable internal components, development tools, templates, processes, or pre-existing NexCraft Studio materials.

NexCraft Studio may continue to use reusable code patterns, workflows, components, and internal tools across future projects.

NexCraft Studio retains ownership of original templates, starter kits, documentation, digital products, and reusable product materials unless otherwise stated in the applicable License Agreement.

6. Client and User Responsibilities

Clients and users are responsible for:

• Providing accurate project requirements, content, and assets
• Giving timely feedback and approvals
• Ensuring they have rights to all provided images, logos, text, brand assets, and materials
• Reviewing deliverables before launch
• Maintaining hosting, domain, payment gateway, and third-party service accounts unless otherwise agreed
• Using purchased templates in accordance with the License Agreement
• Ensuring business, legal, tax, privacy, and compliance requirements are reviewed by qualified professionals where needed

7. Warranties and Support

Custom projects may include a post-launch support or warranty period for bug fixes related to the agreed scope. The duration and coverage depend on the project type and agreement.

This warranty does not cover new feature requests, third-party platform changes, client-side changes, hosting issues, payment provider issues, or problems caused by unauthorised modifications.

Template support, if included, is limited to the support terms stated on the template details page or related purchase information.

Ongoing maintenance and support are available through separate maintenance packages or ad-hoc requests.

8. Third-Party Services

Projects and products may rely on third-party services such as hosting providers, domain registrars, payment processors, analytics tools, email providers, databases, APIs, fonts, maps, storage, or external platforms.

Template payment processing may be handled by Lemon Squeezy, which may apply its own checkout, payment, tax, billing, receipt, refund, and compliance-related policies.

These services are governed by their own terms, pricing, uptime, limitations, and policies. NexCraft Studio is not responsible for outages, policy changes, pricing changes, data loss, service disruptions, account suspensions, or limitations caused by third-party providers.

9. Payments, Cancellations, and Refunds

Deposits for custom projects are generally non-refundable once work has started, as they reserve project time and cover planning, setup, and early development work.

For custom projects, refunds are assessed based on completed work, project stage, and agreed payment milestones.

Final deliverables, source code, deployment access, or handover materials may be withheld until outstanding payments are settled.

Template purchases are processed in SGD through Lemon Squeezy. Any taxes, billing details, receipts, or payment processing behaviour may be handled by Lemon Squeezy during checkout.

For digital products, purchases are generally non-refundable once access or download has been provided, unless required by applicable law.

10. Limitation of Liability

To the fullest extent permitted by law, NexCraft Studio shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of business, loss of data, loss of goodwill, or service interruption.

Our total liability for any claim related to our services or digital products shall not exceed the amount paid by the client or customer for the specific service, project, or product giving rise to the claim.

11. Privacy and Data

Any personal data submitted through this website, account registration, enquiry forms, purchases, downloads, project communication, or service engagement will be handled according to our Privacy Policy.

Clients are responsible for ensuring that their own website, business system, payment flow, analytics setup, forms, and customer data practices comply with applicable privacy, data protection, tax, and business regulations.

12. Termination

Either party may terminate a custom project agreement with written notice.

In the event of termination, the client remains responsible for payment for work completed up to the termination date. NexCraft Studio may pause or stop work until outstanding payments are settled.

NexCraft Studio may suspend or terminate access to digital products if a user violates these Terms of Use, the License Agreement, or attempts to resell, redistribute, share, or misuse purchased template files.

13. Changes to Terms

NexCraft Studio may update these Terms of Use from time to time. Updated terms will be posted on this page with a revised last-updated date.

Continued use of our website, services, or digital products after changes are posted means you accept the updated terms.
